Pima County Attorney Candidate Mike Jette Will Not Prosecute Abortion Cases, Cites Constitutional Privacy


Mike Jette, Democratic Candidate for Pima County Attorney, reacted to the Arizona Supreme Court's abortion decision issued today by stating as follows:

"As Pima County Attorney, I will never prosecute a woman for exercising her right to bodily autonomy by having an abortion, and I will never prosecute a doctor for performing the medical procedure of an abortion. Doing so would be both legally and morally wrong and would also be an inappropriate use of limited taxpayer resources.

"I agree completely with the legal conclusion of Arizona Attorney General Kris Mayes, that Arizona's Constitution fully protects the right of privacy for all people within this state, including all women, and that the right of privacy in our state constitution encompasses the right to have an abortion.

"Unfortunately, the current Pima County Attorney, Laura Conover, made a mistake. She did not assert the right of privacy set forth expressly in Arizona's Constitution in her case as a reason this state's abortion statutes are unenforceable. Arizona's constitutional right to privacy trumps and supersedes any statute passed by the legislature that would ban abortion. Conover's failure to make this most important legal argument, her failure to assert the right to privacy in Arizona's Constitution, is a big reason Conover and Planned Parenthood Arizona lost their case challenging Arizona's abortion ban statute.

"If elected, I will ensure that every state constitutional right, including the right of privacy set forth expressly in Arizona's Constitution, is protected for all the people of Pima County."
