Napoli Shkolnik Applauds EPA's Historic Action on PFAS Regulation in Drinking Water

Napoli Shkolnik, a law firm at the forefront of litigation against PFAS manufacturers, applauds the U.S. Environmental Protection Agency ("EPA") for its landmark decision to establish regulatory limits on per-and polyfluoroalkyl substances ("PFAS") in drinking water. As legal representatives of thousands of public water systems in the Aqueous Film-Forming Foams ("AFFF") Multi-District Litigation ("MDL"), the firm views this action as a pivotal moment in ensuring the safety and cleanliness of drinking water for the American people.

Paul Napoli, serving as co-lead counsel in the AFFF MDL, played a pivotal role in securing approximately $13.6 billion in settlements with 3M and DuPont, two of the leading PFAS manufacturers. This significant financial achievement will be directed towards the remediation of drinking water supplies in public water systems, addressing the contamination caused by PFAS. The timing of these settlements is particularly fortuitous, aligning with the new regulatory requirements for public water systems to test and remediate PFAS under the recent EPA regulations. This infusion of funds together with the $1 billion in grants provided through the Infrastructure Law will substantially aid in the efforts to ensure the provision of safe, clean drinking water, demonstrating a significant advancement in the battle against PFAS contamination and its impact on public health.

The EPA's announcement sets stringent standards for PFAS concentrations, reflecting a critical step forward in mitigating exposure to these harmful chemicals. PFAS, often referred to as "forever chemicals" due to their persistence in the environment and human body, have been linked to various health issues, including cancer, immune system effects, among others.

"We wholeheartedly applaud the EPA for taking decisive action to protect the American people from the dangers of PFAS contamination," said Paul J. Napoli, a partner at Napoli Shkolnik. "Today's announcement is not just a regulatory step; it is a monumental achievement in our ongoing battle against PFAS manufacturers and the devastating impact these chemicals have on public health and the environment."

Napoli Shkolnik's involvement in the AFFF MDL highlights its commitment to confronting the manufacturing entities responsible for PFAS contamination. The firm's advocacy has been instrumental in pushing for regulatory actions to manage PFAS risks. "This new regulation aligns with our firm's commitment to advocating for stringent environmental protections and ensuring that those responsible for pollution are held accountable," Napoli added. "We remain dedicated to our clients and communities impacted by PFAS and will continue to support the enforcement of these new standards to safeguard public health and our environment."
