Flanagan & Bodenheimer Announces $900,000 Victory in Challenging Slip-and-Fall Lawsuit

MIAMI, Dec. 7, 2023 /PRNewswire-PRWeb/ -- Michael T. Flanagan, partner at Flanagan & Bodenheimer, represented the victim of the slip and fall. The incident occurred when the Plaintiff visited a South Florida cafI to buy a snack for her daughter. The cafI had rented entryway floor mats from a vendor to keep the entryway clean and prevent slips. Court documents indicated that discovery revealed no prior slip and fall accidents in the cafI. The lawsuit alleged that when the Plaintiff entered, she stepped on the floor mat and it slipped across the floor, causing her to fall and aggravating a pre-existing injury in her neck.

According to court documents, the defendants knew or should have known about the dangerous condition of the floor surface and floor mat and that the two were not compatible. The Defendants denied that any dangerous condition existed in court documents. In addition, Plaintiff alleged that she had pre-existing herniated discs in her cervical spine which were aggravated by the slip-and-fall incident and ultimately required surgery. However, according to court documents, the defendants' spine surgeon expert witness testified that the Plaintiff's surgery was not necessary and not caused by the fall. The parties settled for $900,000.00 shortly before trial.
