Competition Bureau seeks feedback on its supplementary guidance regarding abuse of dominance
New bulletin addresses legal amendments that came into force in June 2022
GATINEAU, QC , Oct. 25, 2023 /CNW/ - The Competition Bureau is inviting interested parties to provide feedback on its new Bulletin on Amendments to the Abuse of Dominance Provisions.
The Bulletin was developed to provide preliminary guidance on the Bureau's approach to last year's amendments to the Competition Act. These amendments strengthen the abuse of dominance provisions and help the Bureau to better prevent abuse of market power and protect competition.
The Bulletin is designed to complement the general Abuse of Dominance Enforcement Guidelines.

Each submission received by the Bureau will be published on its website unless the provider specifically requests that it be kept confidential.
The provisions now clearly apply to conduct that is intended to harm competition.
The maximum administrative monetary penalty for an abuse of dominance has significantly increased.
Private parties can now apply to the Competition Tribunal to stop abuses of dominance in certain circumstances.
Under the Act, abuse of dominance occurs when a dominant firm or group of firms in a market engages in a practice of anti-competitive conduct with the result that competition has been or is likely to be lessened or prevented substantially.
