The class action lawsuit against SPS Technologies, LLC alleges the manufacturer failed to accurately calculate and pay PLAINTIFF for overtime worked and the correct rate for missed meal premiums. State law provides that employees must be paid overtime and meal break premiums at one-and-one-half times their "regular rate of pay." Due to the rigorous work schedules, DEFENDANT from time to time allegedly required and permitted PLAINTIFF to work without pay on what was suppose to be PLAINTIFF's off-duty meal break. Additionally, Cal. Lab. Code § 226 provides that every employer shall furnish each of his or her employees with an accurate itemized wage statement. From time to time, DEFENDANT violated this by failing to provide wage statements that identified the correct gross and net wages earned.

Furthermore, the class action lawsuit alleges DEFENDANT failed to prevent discrimination, harassment, and/or retaliation in violation of the Fair Employment and Housing Act (FEHA). PLAINTIFF suffered mental anguish due to ongoing work pressures and obligations. DEFENDANT terminated PLAINTIFF for a no-call, no-show and claimed notice of PLAINTIFF's Family and Medical Leave Act (FMLA) status was not received. DEFENDANT allegedly acted in wrongful termination in violation of public policy, as well as disability and/or Family and Medical Leave Act leave harassment.
