OFT Food Safety Lawyers File First Lawsuit In Bagged Salad Cyclospora Outbreak


MINNEAPOLIS, June 22, 2020 /PRNewswire/ -- OFT Food Safety & Injury Lawyers filed the first lawsuit in the multistate Cyclospora outbreak linked to bagged salads sold at Aldi, Hy-Vee and Jewel-Osco stores. The lawsuit was filed in Cook County, Illinois (File No. 2020L006616) on June 22, 2020.

The Plaintiff in the lawsuit contracted Cyclospora from ALDI Little Salad Bar Brand Garden Salad, a salad mix containing iceberg lettuce, carrots and red cabbage. The Plaintiff purchased the salad from an ALDI grocery store in Danville, Illinois in early June. After eating the contaminated salad, the Plaintiff developed severe gastrointestinal symptoms from the parasite and sought medical attention. He required numerous hospital visits and continues to experience symptoms. The suit names Aldi, Inc. as a defendant.

OFT Food Safety Lawyer Ryan Osterholm says that the outbreak shows that the fresh produce industry has not solved its Cyclospora problem. "Every year like clockwork we see a dangerous parasite in our fresh produce. It is long past time both FDA and all of industry take decisive action to prevent it."

Osterholm says his client wants answers to help stop future outbreaks. "My client was very, very ill and wants answers. We believe that an ingredient from a common supplier in all of the implicated salad mixes is to blame. By bringing this case, we hope to quickly identify the contaminated product, trace it back to the grower, and be part of the solution to prevent this from happening yet again."
