LOS ANGELES, July 15, 2019 /PRNewswire-PRWeb/ -- The Los Angeles labor law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP, filed a class action lawsuit against Laboratory Corporation of America alleging that the company failed to properly calculate overtime compensation for their hourly employees. Furthermore, the complaint alleges that Laboratory Corporation of America failed to provide mandatory meal and rest breaks to its employees. The Laboratory Corporation of America lawsuit, Case No. 19STCV21978, is currently pending in the Los Angeles County Superior Court for the State of California. The class action complaint alleges that the company paid their non-exempt employees a non-discretionary incentive wage based upon their performance for the company. The complaint further alleges that the company failed to properly pay the correct amount of overtime compensation due to their non-exempt employees, because the company allegedly failed to include the incentive wage compensation as part of the employees' "regular rate of pay" for purposes of calculating overtime compensation. As a result, the non-exempt employees working in California were allegedly systematically underpaid overtime compensation.

According to the class action complaint, PLAINTIFF is of Asian-Filipino descent and was allegedly subject to racial harassment and discrimination. Within the State of California there exists a substantial and fundamental public policy, set forth in the California Government Code §12900 et seq., which forbids racial and/or national origin harassment/racial discrimination, retaliation, and wrongful termination. Unlawful harassment includes the right to be free from unwanted, offensive racial harassment, and the right to protest such conduct without fear of retaliation or further harm. This public policy of the state is one that benefits the public at large and guarantees the rights of an employee to perform their work free from racial harassment/discrimination/retaliation.
