Nortek Security & Control LLC Faces a Class Action Filed by Blumenthal Nordrehaug Bhowmik De Blouw LLP, That Claims the Company Failed to Provide Proper Breaks


SAN DIEGO, April 22, 2019 /PRNewswire-PRWeb/ -- The San Diego labor law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP, filed a class action lawsuit against Nortek Security & Control LLC, alleging that the company failed to properly calculate overtime compensation for their hourly employees. Furthermore, the complaint alleges that Nortek Security & Control LLC failed to provide mandatory meal and rest breaks to its employees. The class action complaint claims that the company paid their non-exempt employees a non-discretionary incentive wage based upon their performance for the company. The complaint further claims that the company also allegedly failed to provide Plaintiffs and the other members of the California Class with complete and accurate wage statements which failed to show, among other things, the correct overtime rate for overtime worked, including, work performed in excess of eight (8) hours in a workday and/or forty (40) hours in any workweek, and the correct penalty payments or missed meal and rest periods. Cal. Lab. Code § 226 provides that every employer shall furnish each of his or her employees with an accurate itemized wage statement in writing showing, among other things, gross wages earned and all applicable hourly rates in effect during the pay period and the corresponding amount of time worked at each hourly rate.

According to the class action complaint, the company's non-exempt employees were also allegedly unable to take off duty meal breaks due to their rigorous work schedules. California labor laws require an employer to provide an employee required to perform work for more than five (5) hours during a shift with, a thirty (30) minute uninterrupted meal break prior to the end of the employee's fifth (5th) hour of work and a second uninterrupted meal break when employees are required to work ten (10) hours. The complaint claims that the company did not provide their employees who forfeited meal breaks additional compensation.
