Claude de Guise struck off the roll for 10 years in connection with a contract sharing scheme in Laval


MONTREAL, April 16, 2019 /CNW Telbec/ - The Disciplinary Council of the Ordre des ingénieurs du Québec rendered its decision on guilt and sanction in the case of Claude de Guise, who will be struck off the OIQ's roll for a period of 10 years.

Mr. de Guise was found guilty of violating several provisions of the Code of Ethics of Engineers, for tolerating the arrangement of contract sharing scheme that made it possible to circumvent the competitive bidding process of the City of Laval and for participating in that scheme. Furthermore, the respondent drew major personal benefits ? including a large sum of money and a number of gifts ? in exchange for his role in the contract sharing scheme.

The respondent admitted that he had failed to demonstrate the required professional conduct for a number of public contracts awarded by the City of Laval over a period of approximately six years, between 2002 and 2008, while acting as the engineering department manager for the City of Laval.

In its decision, the Disciplinary Council pointed out that "given the nature of the alleged acts and the risk of a repeated offence, which the Council is unable to evaluate, the respondent was heavily sanctioned for the actions he knowingly took and the personal benefits he drew from them."

As Mr. de Guise is no longer an OIQ member, his penalties will be enforced at the time of his reinstatement on the OIQ's roll.

The full version of the Disciplinary Council's decision is available on the OIQ's Web site. In its decision, the Disciplinary Council also ordered Mr. de Guise to pay all costs in connection with the proceedings.

As a reminder, the sanctions imposed by the Disciplinary Council are meant to protect the public by dissuading professionals from repeating offences and by setting an example for other members of the profession.
