Commissioner of Canada Elections Enters into Compliance Agreement with Daryl Black


GATINEAU, QC, Nov. 15, 2018 /CNW/ - The Commissioner of Canada Elections has entered into a compliance agreement with Daryl Black. In signing the agreement, Mr. Black acknowledged that he had negotiated a prohibited lease agreement with the now deceased Official Agent of the Conservative Party of Canada candidate in the electoral district of Dufferin?Caledon during the 2015 general election. The lease agreement set out the terms of the lease including a tax receipt for Mr. Black for a non-monetary contribution in the amount of $1,500 to the campaign of the candidate. The Canada Elections Act prohibits entering into an agreement for the provision of goods or services to a registered party or candidate, a condition of which is for someone to make a political contribution.

Compliance agreements are voluntary and outline the terms and conditions that the Commissioner considers necessary to ensure compliance with the Canada Elections Act. These agreements may include a statement by the individual or organization ("contracting party") admitting responsibility for the act or omission constituting the offence. The admission of responsibility does not constitute a criminal conviction by a court of law and does not create a criminal record for the contracting party. More information about compliance agreements can be found at sections 517 to 521 of the Canada Elections Act.

The Commissioner of Canada Elections is the independent officer responsible for ensuring compliance with, and enforcement of, the Canada Elections Act and the federal Referendum Act.
