Frier Levitt Launches Maximum Allowable Cost (MAC) Reimbursement Rights Practice Group Helping Pharmacies Fight Unfair Pharmacy Benefit Manager (PBM) Practice

Frier Levitt's MAC Pricing Practice Group, led by Lucas W. Morgan, Esq., assists pharmacies in fighting unfair MAC reimbursements by Pharmacy Benefit Managers (PBMs), examines the legality of PBMs' MAC pricing, MAC reimbursement, and ensures that pharmacies take advantage of state laws restraining unfair PBM practices.

Frier Levitt has observed troubling trends pertaining to PBMs' MAC practices, including how MAC pricing is determined, MAC reimbursement to pharmacies, and the amount charged to plan sponsors. Because there is no generally accepted reference price for multisource generic drugs, pharmacies are usually reimbursed by PBMs for these drugs based on a MAC price list created by the PBM. MAC prices are usually set by the PBM with pharmacies having no access to the methodology utilized by the PBM.
