Ethicon Transvaginal Mesh Lawsuit Goes to Trial in New Jersey, Bernstein Liebhard LLP Reports

NEW YORK, Dec. 13, 2017 /PRNewswire/ -- New Jersey has convened its second trial of a transvaginal mesh lawsuit involving devices manufactured by Ethicon, Inc.

According to court documents pending in Bergen County Superior Court, the case was filed on behalf of a New Jersey woman who allegedly suffered painful complications following implantation of Ethicon's Prolift and TVT-Obturator devices to treat stress urinary incontinence. In opening arguments on November 27th, the Plaintiff's attorney asserted that Ethicon was aware that the polypropylene used in its pelvic mesh implants could potentially harm vaginal tissue, but failed to provide adequate warnings to patients and doctors. More than 50,000 similar transvaginal mesh lawsuits have been filed against Ethicon and its parent company, Johnson & Johnson, in courts around the country. Thousands of additional claims have been filed against American Medical Systems, Boston Scientific Corp., C.R. Bard, Inc. and other device manufacturers. Of 31 cases that have gone to trial, 22 have concluded with verdicts for the plaintiffs and damage awards in excess of $1 million.
