Berger & Montague, P.C. Announces Investigation Regarding the University Hospitals Ahuja Medical Center and Pacific Fertility Center That are Alleged to Have Damaged Patients' Frozen Eggs and Embryos


PHILADELPHIA, March 14, 2018 /PRNewswire/ -- Berger & Montague, P.C. has begun an investigation regarding the possible loss of frozen eggs and embryos at the Cleveland-area fertility clinic University Hospitals Ahuja Medical Center.

As reported by The Washington Post and other sources, due to a temperature malfunction in one of the University Hospitals Ahuja Medical Center's storage banks that occurred between Saturday, March 3, 2018 and Sunday, March 4, 2018, more than 2,000 frozen eggs and embryos may have been damaged such that they are no longer viable. The hospital has informed about 700 patients that their frozen samples may have been impacted, although the extent of the damage is still being determined.

According to a statement released by the hospital on March 8, 2018, it does not know how or why the temperature fluctuated and is investigating what happened.

It was also reported that a similar incident occurred on March 4, 2018 at the Pacific Fertility Center in San Francisco, CA. Berger & Montague, P.C. is investigating that event as well. Specifically, officials at the Pacific Fertility Center blamed the problem on the fact that the level of liquid nitrogen in one of the clinic's steel storage tanks had fallen too low, causing the temperature in the tanks to rise. It was reported that the storage tank contained "several thousand" eggs and embryos, representing as much as 15 percent of the total stored at the facility.
