Colorado Attorney David Klibaner Examines Slip-and-Fall Essentials


DENVER, Feb. 15, 2018 /PRNewswire-PRWeb/ -- Falls are the third most common cause of unintentional injury and death in the United States, and the leading cause of death for adults over 65. "Very often, serious slip-and-fall injuries result when a business fails to follow basic safety rules to ensure that floors, sidewalks or stairs are safe," said personal injury attorney David Klibaner, founding partner of Klibaner Law Firm, which only represents people, and never insurance companies.

To educate people on what to do if injured in a slip-and-fall accident in a business, Klibaner lists the following five tips:

No. 1: Report the fall immediately to a person in charge, and get medical treatment if needed. "As an attorney handling a lot of slip-and-fall cases, I find too often the retail store has 'lost' or erased the video of where the fall happened, but the store has videotape showing that the person who fell kept shopping for a little while," noted Klibaner. "The insurance company handling any potential claim will argue you could not have been hurt since you did not get immediate medical attention."

No. 2: Fill out an incident report and get names of witnesses. Get the names, if possible, of any employees who saw the fall. "Furthermore, if there are any potential witnesses in the area, get their names and phone numbers as well," stressed Klibaner.

No. 3: Photograph the area where the fall occurred. "If you have a cell phone camera, use it to take pictures of the area," advised Klibaner.

No. 4: Keep your shoes. Bag them and don't wear them again. "They may be important evidence," added Klibaner.

No. 5: Write down what happened. "Describe how you fell as best you can. Did you fall forward or backward? Did you hit your knee, your head, your butt? If you have a recording device on your phone, use that," concluded Klibaner. "It is easy to forget how you fell as time passes, and anything that is unclear will be used against you."
