Attorney John H. Davis & Associates Files Fraud Lawsuit on Behalf of Bennie Kennedy


HAMMOND, Ind., Jan. 29, 2018 /PRNewswire/ -- Attorney John H. Davis & Associates announces that its client Bennie Kennedy has filed a lawsuit against Prairie State College in Chicago Heights, Illinois for fraud by allegedly authoring a false and fictitious document which the lawsuit says provided and assisted a French global electric company in obtaining a summary judgment in the company's favor. The lawsuit alleges that Prairie State College through Dean Marie Hansel authored the above-mentioned document.

Attorney John H. Davis & Associates announces that its client Bennie Kennedy has also filed a lawsuit against his employer ? the French global electric company, Schneider Electric - according to the lawsuit for defamation stemming from a telephone call made by a then Schneider Electric employee (Gloria Olson) to Prairie State College which allegedly implied that Bennie Kennedy used or was attempting to use proprietary material belonging to Schneider Electric.

The lawsuit filed against Schneider Electric was filed by Bennie Kennedy prior to the lawsuit filed against Prairie State College and thus both lawsuits have two (2) separate docket numbers, however, both cases are related and one (1) case affects or will affect the other case.

The lawsuit against Prairie State College alleges that Prairie State College through Dean Hansel authored the above-mentioned false Declaration which was allegedly solicited by Schneider Electric to assist Schneider Electric in their (Schneider Electric's) effort to convince a Federal Magistrate Judge (Paul R. Cherry) in granting the motion for a summary judgment.

The lawsuit alleges also that Prairie State College, upon receiving a telephone call from Gloria Olson of Schneider Electric, only then began to question Bennie Kennedy's qualifications to teach courses at Prairie State College. It is alleged that this action was taken by Dean Hansel who stated in a false Declaration that a decision to suddenly check Bennie Kennedy's qualification to teach Basic Electricity and Occupational Safety and Health Administration courses was not prompted by a telephone call from Schneider Electric. However, as alleged in the lawsuit, the action was taken within days after the telephone call and led to his immediate dismissal from Prairie State College.

According to the lawsuit, Bennie Kennedy had been teaching at Prairie State College for over six (6) years when Dean Hansel decided it was necessary to check his qualifications. It is further alleged that Bennie Kennedy's qualifications at the point when Dean Hansel did the review of his qualifications consisted of materials held in his (Bennie Kennedy's) Human Resources file at Schneider Electric. The contents of the file reflect that Schneider Electric was allegedly aware that the Declaration of Marie Hansel was false.

Subsequently, Bennie Kennedy as plaintiff through his Attorney John H. Davis filed a Rule 60(d)(3) - Motion to Set Aside Judgment for Fraud on the Court (Summary Judgment) against Schneider Electric pursuant to Federal Rules of Civil Procedure.
