Bloomberg Law Litigation Analysis Shows TC Heartland Case's Dramatic Impact On Texas Patent Litigation

ARLINGTON, Va., Oct. 19, 2017 /PRNewswire-USNewswire/ -- A new litigation analysis report released today by Bloomberg Law examines intellectual property litigation trends in the third quarter of 2017, finding that patent infringement complaints filed in the Eastern District of Texas are down more than 50 percent compared to the second quarter. Litigation Analysis ? Q3 2017 investigates the overall impact of the Supreme Court decision TC Heartland v Kraft Foods on patent litigation strategy, which has been dramatically impacted by the watershed ruling over the most recent three month period.  The report is the first in a quarterly series of reports from Bloomberg Law that will explore intellectual property litigation, including trade secrets, copyrights, trademarks and patents.  A copy of the report is available for download at http://on.bna.com/pVjJ30fZnF7.

The new report further explores the inconsistent application of venue rules and analyzes data on top patent judges and law firms and plaintiffs who most often appear before those judges.  The insights in the report are presented through a combination of expert analysis and data accessed using Bloomberg Law's full complement of patent litigation resources, including a comprehensive database of dockets and court opinions, and Litigation Analytics, which draws on court opinions (both published and unpublished) and docket information.  Litigation Analytics informs attorneys' litigation strategies and helps them to understand potential impacts of judges and courts.

"The patent litigation landscape has experienced such a significant shift over the past quarter," said Alex Butler, vice president and general manager of Corporate, IP, and Tech & Telecom for Bloomberg Law. "We wanted to offer both corporate counsel and patent attorneys practicing in law firms new perspectives from our team's in-depth analysis and data on filing trends and key decisions as they consider their dispute resolution and litigation strategies.  Bloomberg Law continually monitors and reports on developments in intellectual property litigation and this intelligence enables attorneys to provide better counsel."
