Caldwell Cassady & Curry Win for VirnetX Affirmed in $439 Million Judgment


DALLAS, Oct. 16, 2017 /PRNewswire/ -- A Texas federal judge has entered a $439.7 million patent infringement judgment against Apple Inc. (NASDAQ: AAPL) following a verdict won last year by attorneys from Dallas' Caldwell Cassady & Curry in favor of Nevada-based VirnetX Inc. (NYSE MKT: VHC), an internet security software and technology company.

The case focused on internet security patents owned by VirnetX that Apple used without permission to produce popular features such as FaceTime on the company's iPhones and other products.

The judgment handed down Sept. 29, 2017, by Judge Robert W. Schroeder III in the U.S. District Court for the Eastern District of Texas affirms a $302.4 million verdict won by Caldwell Cassady & Curry on behalf of VirnetX in September 2016. The case is VirnetX Inc., et al. v. Apple Inc., No. 6:10-CV-417.

In addition to the verdict amount, the court also ordered Apple to pay more than $41 million in enhanced damages and more than $96 million in court costs, attorneys' fees and prejudgment interest.
