Announcing a Class Action Settlement Involving All Persons who purchased an Extended Services Plan from Staples in New York State between February 1, 2010 and August 31, 2013


NEW YORK, Sept. 28, 2017 /PRNewswire/ -- A $3.95 million Settlement has been reached to pay Claims from people who purchased an Extended Services Plan ("Protection Plan") from Staples in New York between February 1, 2010 and August 31, 2013. The Settlement resolves a lawsuit that claimed Staples misrepresented the terms and conditions of the Protection Plans and failed to adequately disclose that the Protection Plans required consumers to use coverage available under the manufacturer's warranty before obtaining coverage under the Protection Plans. Staples denies the allegations in the lawsuit, and the Court has not decided who is right. The legal rights of Class Members are affected whether or not they act.

The Settlement includes all persons who purchased an Extended Services Plan from Staples in New York State between February 1, 2010 and August 31, 2013. Class Members can find the included plans at www.StaplesSettlement.com.

Class Members who registered their Protection Plan, may receive an automatic payment. Class Members who did not register their Protection Plan, must file a Claim to receive a payment. The best way to ensure payment is to complete a Claim Form, even if a Class Member registered their plan. Class Members can file their Claim online at www.StaplesSettlement.com. Class Members can get a paper Claim Form by visiting the Settlement Website, emailing [email protected], or calling 1-888-457-2303. The deadline to file a Claim online is 11:59 p.m. PST on February 26, 2018. Mailed Claims must be postmarked by February 26, 2018.

Class Members who do not want to be legally bound by the Settlement, must exclude themselves by November 27, 2017. Class Members who do not exclude themselves will release any Claims they may have, more fully described in the Settlement Agreement, which is available at the Settlement Website. Class Members who want to object must object to the Settlement by November 27, 2017. The detailed Notice available at www.StaplesSettlement.com explains how to exclude or object. The Court will hold a Hearing on December 13, 2017 at 11:00 a.m. to consider approving the Settlement, a request for attorneys' fees of up to 30 percent of the Settlement Fund, and a service award of $5,000 to the Plaintiff. Class Members may appear at the Settlement Hearing, either by themselves or through an attorney hired by them, but it is not necessary.
