USPTO Confirms Patentability of U.S. Patent No. 9,180,140 Exclusively Licensed by ThermoLife International


LOS ANGELES, Sept. 20, 2017 /PRNewswire/ -- ThermoLife International, LLC announced today that the United States Patent and Trademark Office (USPTO) has issued a Notice of Intent to Issue Ex Parte Reexamination Certificates for Patent No. 9,180,140, which is exclusively licensed by ThermoLife from HeartBeet Ltd.  The Patent's claims generally pertain to reducing oxygen consumption and enhancing physical performance of humans by taking nitrates, and is part of ThermoLife's broader patent portfolio consisting of hundreds of claims pertaining to amino acid/nitrates and their compounds, compositions, and uses.  The nitrate-related inventions owned and licensed by ThermoLife are based on groundbreaking recognitions regarding the benefits of supplementing the diet with nitrates, particularly to increase athletic performance, and have contributed to the popularity of nitrates in the sports nutrition industry.  ThermoLife has licensed its patented technology to some of the largest sports nutrition companies in the United States.  The favorable outcome in this reexamination proceeding will result in even stronger claims and further fortify ThermoLife's position and leading role in the industry.

The Patent Office's recognition of the patentability of these patent claims will allow ThermoLife to continue its patent enforcement actions, including those that have been stayed as a result of reexaminations, including those against Hi-Tech Pharmaceuticals, Neogenis/HumanN, and MusclePharm.  As stated by ThermoLife's owner, Ron Kramer, "ThermoLife consistently has believed that these patent claims were valid all along, and the outcome of the reexamination proceeding has now underscored this."
