CertainTeed Gypsum Canada Welcomes CITT US Drywall Injury Determination


Final Duty Remedy Requires Complete Data

MISSISSAUGA, Ontario, Jan. 6, 2017 /CNW/ -- CertainTeed Gypsum Canada welcomes the January 4th Canadian International Trade Tribunal finding that dumped US drywall imports into Western Canada "have caused injury to the domestic industry".

Both high dumping margins and material injury have now been affirmed twice by Canadian authorities. It validates CertainTeed Gypsum Canada's Anti-Dumping Complaint that Western Canadian manufacturing has suffered material injury from large volumes of US drywall imports sold at low prices with huge dumping margins.

In regard to the specific CITT recommendations, CertainTeed Gypsum Canada offers these provisional comments subject to the CITT's statement of reasons expected January 19.

  1. As we cautioned throughout the proceeding, and as the CITT has now affirmed, the expedited and unprecedented process and recommendations have been made based on a "limited amount of data available." We remain concerned about the implementation of any permanent or long-term reduction in the level of Duties absent full and complete information.
  2. CertainTeed Gypsum Canada supports short-term relief for contractors who established fixed-price contracts prior to September 6th, 2016. CertainTeed Gypsum Canada, however, remains concerned with implementation of such relief. Any Provisional Duty remission or temporary Final Duty remission should only be paid to and for the benefit of contractors, and not US importers who are dumping. CertainTeed Gypsum Canada does not support any temporary remission that would condone continued injurious dumping in Western Canada
  3. Regarding the full 6 month remission and the Final Duty reduction recommendations, CertainTeed Gypsum Canada is concerned that these proposals would condone and encourage continued injurious dumping in Western Canada, albeit at a partially reduced dumping margin. Continued dumping at high margins puts at risk the job security of employees rehired by CertainTeed Gypsum Canada in our Western Canadian plants, jeopardizes our ability to increase investments in Western Canada, and undermines any prospect that idled Western Canadian plants will reopen and create significant jobs and investment in the Western Canadian drywall industry.
  4. CertainTeed Gypsum Canada continues to support in principle, as we first recommended, an exclusion for Fort McMurray region, which was raised as the primary National Interest concern by the Governor-in-Council, although as the CITT have stated the need for such a regional exclusion may be unnecessary if a material Duty reduction is implemented.
